HEALTH CONDITION AND PERSONAL INJURY

Participation in all exercise is at your own risk. You are responsible for your own state of health and participation in all activities at ACE MMA is at your own risk. ACE MMA will not be liable for any personal injury resulting from an accident or the actions or lack of action by other visitors or yourself.

You should not exercise beyond your own abilities. If you know or are concerned that you have a medical condition which might interfere with you exercising safely, before you use our equipment and facilities you should get advice from a relevant medical professional and follow that advice.

Please read the following.

*Ask any staff member to guide you into the most suitable group class or exercise program (especially when just beginning)

*Work at a low level on your first few visits & concentrate on learning correct techniques and be sure to limit yourself to a comfortable pace.

*If you suffer any injury, illness or condition in the future, please tell us.

Statement: I recognise that the instructor is not able to provide me with medical advice with regards to my medical fitness.

Release and Waiver of Liability and Indemnity Agreement

I ACKNOWLEDGE that activity I am to undertake is a dangerous activity and that by participating in it I am exposed to certain risks and dangers.

1. I/WE fully understand and acknowledge that whilst participating in such activity:

(a) I will be injured, physically and/or mentally, partial and/or total disability, paralysis or may die.

(b) I have sole responsibility for my personal property which may be lost or damaged.

(c) Other persons participating in such activity may cause me injury or may damage my property.

(d) I may cause injury to their persons or damage their property.

(e) The conditions in which the activity is conducted may vary without warning.

(f) The social and economic losses and/or damages, which could result from these risks and dangers described above, could be severe.

(g) These risks and dangers may be caused by the action, inaction or negligence of me the participant or the action, inaction or negligence of others, including, but not limited to, the Releasees named below.

(h) There may be other risks not known to the Releasees or are not reasonably foreseeable at this time.

2.I/WE understand and agreed that, if at any time, I feel anything to be UNSAFE, I will immediately take all precautions to avoid the unsafe area and REFUSE TO PARTICIPATE further.

3. I/WE accept and assume such risks and responsibility for the losses and/or damages following such injury, disability, paralysis or death, however caused and whether caused in whole or in part by the negligence of the Releasees named below.

5. I/WE HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE ACE MMA, including its owners, managers, promoters, lessees of premises used to conduct the martial arts/fitness activities, event(s) and/or program, premises and event inspectors, underwriters, consultants and others who give recommendations, directions, or instructions to engage in risk evaluation or loss control activities regarding the martial arts facility, events or activity held at such facility and each of them, their directors, officers, agents, employees, all for the purposes herein referred to as “Releasee” FROM ALL LIABILITY TO YOU (THE UNDERSIGNED), my/our personal representatives, assigns, executors, heirs and next to kin FOR ANY AND ALL CLAIMS, DEMANDS, LOSSES OR DAMAGES AND ANY CLAIMS OR DEMANDS THEREFORE ON ACCOUNT OF ANY INJURY, INCLUDING BUT NOT LIMITED TO DEATH OR DAMAGE TO PROPERTY, ARISING OUT OF OR RELATING TO THE ACTIVITY, PROGRAM OR EVENT(S) CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASEE OR OTHERWISE.

6. I/WE HEREBY acknowledge that THE ACTIVITIES I am to undertake is VERY DANGEROUS and involve the risk of serious injury and/or death and/or property damage. I/WE also expressly acknowledge that INJURIES RECEIVED MAY BE COMPOUNDED OR INCREASED BY NEGLIGENT RESCUE OPERATIONS OR PROCEDURES OF THE RELEASEES.

7. I/WE further expressly agree that the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by law and that if any portion is held invalid, it is agreed that the balance shall, notwithstanding continue in full legal force and effect.

PRIVACY RELEASE

I, hereby grant ACE MMA and any assigns, licensees, and legal Representatives of ACE MMA, the irrevocable right to use my name (or any fictional name), picture, portrait, or photograph in all forms and media in all manners, including composite or distorted representations, for advertising, trade, or any other lawful purposes, and I waive any right to inspect or approve the finished version(s), including written copy that may be created in connection therewith. I am of lawful age and or I am the legal guardian of the above named. I have read this release and am fully familiar with its contents.

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
